Welcome to Kelepera. These Terms of Service ("Terms") govern your access to and use of our website and the purchase of products from our online store.
By accessing our website or placing an order, you agree to these Terms. If you do not agree, please do not use our website or purchase our products.

Our Products
Kelepera sells original artwork, including one-of-a-kind paintings and works on paper.
Each artwork is individually created and may contain natural characteristics that are part of the artistic process. Product descriptions, dimensions and photographs are provided as accurately as possible. However, colours and appearance may vary slightly depending on your screen settings and device.
All artworks remain subject to availability until your order has been accepted.
Orders
When you place an order, you are making an offer to purchase.
Your order is accepted when you receive an order confirmation from us. We reserve the right to decline or cancel an order if:
- the artwork is no longer available;
- incorrect pricing or product information has been displayed due to a technical error;
- fraud or unauthorized payment is suspected; or
- we are otherwise unable to fulfil the order.
If your payment has already been processed, any amount paid will be refunded.
Prices and Payment
All prices displayed on our website are stated in the applicable currency and include VAT where required by law.
Shipping costs are shown during checkout before your order is completed.
Payment must be completed before an order is dispatched.
Shipping and Delivery
We ship within Denmark and internationally where available.
Estimated delivery times are provided for guidance only and are not guaranteed. Delays caused by shipping carriers, customs authorities or circumstances beyond our reasonable control may occur.
Risk of loss or damage passes to the customer upon delivery of the goods, in accordance with applicable consumer law.
Returns and Right of Withdrawal
Customers residing in the European Union are entitled to a 14-day right of withdrawal in accordance with applicable consumer protection legislation.

Custom-made or commissioned artworks created according to the customer's individual specifications are exempt from the statutory right of withdrawal as permitted under Article 16(c) of Directive 2011/83/EU.
Faulty or Damaged Goods
If your artwork arrives damaged, defective or incorrect, please contact us as soon as reasonably possible after delivery.
Nothing in these Terms limits your statutory rights relating to goods that are faulty or not in conformity with the sales contract under applicable consumer protection legislation.
Intellectual Property
The purchase of an artwork transfers ownership of the physical artwork only.
Unless otherwise agreed in writing, Kelepera retains all copyrights and other intellectual property rights relating to the artwork.
This includes, but is not limited to, the exclusive right to reproduce, publish, license, distribute, create derivative works from, or commercially exploit the artwork.
Customers may not reproduce the artwork for commercial purposes or use images of the artwork for commercial exploitation without prior written permission.
We reserve the right to use photographs of sold artworks for our portfolio, website, exhibitions, social media and promotional materials unless otherwise agreed in writing.
Website Use
You agree to use our website only for lawful purposes.
You may not:
- interfere with the operation or security of the website;
- attempt unauthorized access to any part of the website;
- copy or reproduce website content without permission;
- use automated systems or bots in a manner that disrupts normal operation; or
- violate applicable laws while using our website.
Third-Party Services
Our website is hosted by Shopify and may include services provided by third parties, including payment providers and shipping partners.
We are not responsible for the content, privacy practices or services provided by third-party websites or providers.
Privacy
Your personal information is processed in accordance with our Privacy Policy.
By using our website, you acknowledge that your information may also be processed by Shopify and other service providers involved in processing your order.
Limitation of Liability
Nothing in these Terms excludes or limits liability where such limitation is prohibited by applicable law.
To the maximum extent permitted by law, Kelepera shall not be liable for indirect, incidental or consequential losses arising from the use of our website or the purchase of our products.
Our total liability shall in no event exceed the amount paid for the relevant order.
Nothing in these Terms affects your statutory consumer rights.
Force Majeure
We shall not be liable for delays or failure to perform our obligations where such delay or failure results from events beyond our reasonable control, including but not limited to natural disasters, war, strikes, pandemics, governmental actions, transportation disruptions or failures of suppliers or carriers.
Governing Law
These Terms shall be governed by the laws of Denmark.
If you are a consumer residing in another EU Member State, you also benefit from any mandatory consumer protection provisions applicable in your country of residence.
Any disputes shall be subject to the jurisdiction of the competent Danish courts unless mandatory consumer protection legislation provides otherwise.
Changes to these Terms
We may update these Terms from time to time.
The version published on this website at the time of your purchase shall apply to your order.
